Rules & regulations in renting house or renting residential properties in Singapore has changed from time to time. Home - Condo
Parties involved in Renting House or Renting Residential Property
Landlords or owners of the house
By law, contract or tenancy agreement for renting must be signed by all owners who have their name in the title of property.
Tenants, who are renting house
Tenants in the contract referring to the signatory & their family. Tenants must be Singaporean, Permanent Residences or Foreigners who have working visa. Foreigner who hold visit pass are not allow to rent house or residential property in Singapore. They need to rent hotel or services apartments.
Corporate Tenants
Company of firms renting & sign tendency agreement for workers to stay. Number of company’s workers (occupiers) are kept as 2 per room. In case of multiple families or unrelated person, the maximum number of 6 pax applied.
Occupiers
Occupiers refer to family of tenant whose names are not in the signed tenancy agreement with landlords. This also includes Domestic worker or maid. Sub-tenants, if allowed by landlord in the signed tenancy agreement.
Number of Tenants & Occupiers in
Apartment & Condo For Rent
Total number of Tenants includes occupiers are kept maximum to the number of bedrooms. For illustration: 3 bedrooms are are able to accommodate 6 pax in total. However, non-related tenants are to be kept up to maximum 6 pax, includes tenant & their family. For example, friends who are sharing room rental, sub-tenants, co-workers. Domestic worker or maid of tenant is considered part of tenants’ family.
Property Types Involved in Apartment & Condo For Rent
Public Housing or HDB Apartment For Rent
HDB House are leased properties by Singapore Housing Development Board. Therefore renting HDB is subjects to HDB rules & regulations. House that leased from HDB under 5 years are not allow to rent out the entire unit. However, they are looked to rent some rooms out.
Executive Condominium or EC For Rent
EC are hi-breed HDB & Private Apartments. EC will turned to private property of privatised after 10 years from TOP. Before privatised, HDB rules & regulation in rental applied. After privatised private residential rules apply.
Private Residential Apartment or Private Condo For Rent
Renting House or Renting Residential Property are subject to rule & regulation by Urban Redevelopment Authority (URA).
Serviced Apartments or Service Residential Property
Referring to the property run under Hotel licences that rent out with shorter terms comparing to other types.

Private Residential Property
According to URA regulations, private residential property includes home, condo & apartment for rent must be rented out for at least three consecutive months. they are not allowed to be rented daily or weekly basis.
For EC within 5 years from TOP & HDB rental
According to HDB Regulations, minimum occupancy period must be at least 6 months. Maximum period for Malaysian & Citizen is 3 years, otherwise is 2 years.
In practice, the tenancy period in Singapore are 2-3 years. It also quite practical as times go by, both parties might need to review many things. Landlords might need to review the market rent & tenants performance. On the other hand, tenants also need to review the condition of the units & maybe the future plans. For Example: School location for children, market rental rate, landlords practices, works & employment plan, etc.
Singapore practice also seen those cases includes 2 years plus 2 years extensions with agreed condition. However it is subject for negotiations before the tenancy agreement being signed.
Termination of Tenancy Agreement by Tenants
Termination of Tenancy Agreement (TA) in this case referring to the break of tenancy agreement before the stipulated period. This only allowed after the minimum occupancy time by tenants, which is usually after tenant stay on for 12 months, then they can make request to landlord in advance(as agreed in TA. The reasons for Termination also must be valid reasons. For Instance: Visa was cancel or terminated by authority, Tenants working contract is terminated by Tenants’ employer. In case of corporate tenants who rent of their employers & terminate the employment, compensations may apply according to the agreement in TA.

Validity of Tenants Visa
Non-citizen legally residing in Singapore who holds an Employment Pass, S Pass, Work Permit, Student Pass, Dependant Pass, or Long-Term Social Visit Pass. The pass must have a validity period of at least 6 months as at the date of application by the flat owners:
Work Permit holders from the construction, marine, and process sectors must be Malaysians. Work Permit holders from the manufacturing sector must also be Malaysians if they are renting a whole HDB flat. Tourists are not allowed to rent any HDB flat/ bedroom
HDB requirement for Tenants to have valid 6 months
Additional criteria for tenants renting HDB Apartment
If you are a non-Malaysian non-citizen (Singapore Permanent Resident or foreigner) renting the HDB flat, you will be subject to the Non-Citizen Quota for Renting Out of Flat. The quota is to help maintain a good ethnic mix in HDB estates. Malaysians are not subject to this quota in view of their close cultural and historical similarities with Singaporeans.
The quota is set at 8% at the neighbourhood level and 11% at the block level, and applicable if any tenant renting the flat is a non-Malaysian non-citizen. If the quota is reached, only Singaporeans and Malaysians can rent a flat in that neighbourhood/ block. This quota does not apply to the renting out of bedrooms.

Taxation for Home Apartment & Condo For Rent
Taxation in Tenancy Agreement or Stamp Duty
A lease with fixed rental is one for which a fixed rental is agreed upfront for the entire lease period. Stamp duty on the fixed rental is based on lease duty rates. Tenants are reliable for paying Stamp Duty for Tenancy Agreement at 0.4% of Total Rent, by Law.
